
Complex Divorce Settlement Agreement Meeting and Paperwork

Complex Divorce Settlement Agreements
This specialized approach involves several key steps to help you navigate the legal aspects of your separation in an amicable manner. All divorces include the issues of finances, assets & liabilities, real and personal property, taxes, insurance and custody (if you have children). It is not uncommon for couples to be at odds with any one or several of these topics. When couples are unable to communicate we make the process simple by giving each of you a legal consultant who is dedicated to you throughout the process.
Step 1: The initial step is to email or call us to schedule your first appointment. After the initial contact our office will send both of you a lengthy questionnaire to fill out to take with you to your initial meeting with your individual legal consultant.
Step 2: At your initial meeting you will go over your questionnaire in detail and cover all the topics necessary for you to resolve before proceeding to the next step of creating a Separation Agreement. Your family law attorney is dedicated to listen to your unique circumstances, concerns, and objectives relating to the divorce. This individualized approach allows the legal consultant to gain in-depth insights into each party's perspective and priorities. The topics discussed will include, but are not limited to: financial support/alimony, child support, division of personal and real property, apportionment of debt, filing of State and Federal income taxes, health and life insurance, allocation of retirement accounts, legal and physical child custody, parenting plans, post secondary education, and name change. The initial meeting will flush out those issues that are sticking points and solidify those that are agreed upon.
Step 3: Following the initial consultations, each party, with their legal consultant, will engage in two separate 2 hour meetings or one 4 hour Settlement Meeting to address the issues identified during the initial consultation. These meetings serve as a platform for facilitated discussions, where parties can address complex issues, navigate disagreements, and work towards reaching mutually acceptable solutions under the guidance of their legal advisors.
Throughout the settlement sessions, the attorneys play a crucial role by fostering constructive dialogue, helping parties articulate their needs and concerns, clarifying legal aspects, offering different perspectives and propose other solutions to facilitate productive negotiations. The attorneys assist parties in exploring various options, understanding implications, and making informed decisions that align with their family’s best interests. Throughout the settlement sessions, the couple is encouraged to communicate openly and express their wishes while actively listening to each other's perspectives.
Step 4: When you and your spouse reach a consensus on all relevant matters the final step involves the legal consultants collaborating to prepare the Separation Agreement which explains the agreed upon terms in legal ease. The Complex Divorce Separation Agreement will cover all topics of the divorce so there are no future misunderstandings between the parties.
Step 5: In addition, we will prepare all other paperwork including, a Joint Petition – Non-adversarial Divorce form, Notice of Automatic Orders, Waiver of Service, Case Management Agreement, Financial Affidavits, Worksheet for Child Support and an Affidavit Concerning Children. A draft of all the paperwork will be sent to you and your spouse to make sure it accurately reflects your decisions. If there are any changes we revise the paperwork as necessary and send it back to you for a final review and signatures. All paperwork is then submitted to the Court for processing and to formalize the Agreement by becoming orders of the Court.
A divorce should be granted by the Court within 35 days.
