What is Uncontested Divorce Paperwork?
Uncontested divorce paperwork refers to the legal documents required to finalize a divorce in which both parties agree on all major issues, such as property division, child custody, and spousal support. This type of divorce is often faster and less expensive than contested divorces, where the parties cannot agree and require court intervention to resolve disputes.
If you are unfamiliar with the legal system, initiating a dissolution of a marriage lawsuit and filing the appropriate paperwork can be a daunting task. We alleviate that burden by gathering information, filling out the paperwork and filing it for you, eliminating the need for you to go to Court. The process is simple.
How To File For an Uncontested Divorce
Step 1: Email or call Divorce The Right Way to schedule your first appointment. If you and your spouse can meet together (digitally or in person) it will expedite the process. Otherwise, we are happy to meet with the two of you separately. After the initial contact with our office will send you a lengthy questionnaire for you to fill out and take with you to the initial consultation.
Step 2: At our initial meeting we will go over your questionnaire in detail and cover all the topics for you to address before proceeding to the next step; creating a Separation Agreement. These topics include, but are not limited to: financial support/alimony, child support, division of personal and real property, apportionment of debt, filing of State and Federal income taxes, health and life insurance, allocation of retirement accounts, legal and physical child custody, parenting plans, grandparents visitation, post secondary education, relocation and name change.
If there are issues that you haven’t talked about or didn’t know how to handle we can suggest options and guide you. After the initial consultation you will know the areas of focus for you and your spouse to discuss and settle.
Step 3: When you and your spouse have a resolution to all topics we can meet to iron out the details and begin to prepare the Separation Agreement. This meeting can be done digitally, in person or by way of emails if all topics are finalized. At this meeting we will gather the information, systematically go through your decisions and translate them into legal ease for the Court.
Step 4: Divorce The Right Way will prepare all the necessary uncontested divorce paperwork for you based upon the information you provided to us in the questionnaire and our meetings, which will include, a Joint Petition – Non Adversarial Divorce form, Notice of Automatic Orders, Waiver of Service, Case Management Agreement, Financial Affidavits, Worksheet for Child Support, Affidavit Concerning Children and a Separation Agreement.
A draft of all the paperwork will be sent to you and your spouse to review. If there are any changes we revise the paperwork as necessary and send it back to you for your final examination and signatures. Our office will file all the paperwork with the Court. A divorce should be granted by the Court within 35 days.
